OVERVIEW

This website is operated by Coyote Creek Co. LLC. Throughout this website, the terms “we,” “us,” and “our” refer to Coyote Creek Co.

By visiting our website, purchasing a product, submitting artwork, or otherwise using our services, you agree to these Terms of Service. If you do not agree to these terms, please do not use the website or place an order.

Our online store is hosted by Shopify, which provides the e-commerce platform that allows us to offer products and services to you.

  1. ELIGIBILITY

You must be at least the age of majority in your state or place of residence to use this website and make purchases.

You may not use our products, website, or services for any unlawful or unauthorized purpose. You may not violate any applicable federal, state, or local law through your use of the website or our products.

  1. KNIFE PURCHASES AND LEGAL COMPLIANCE

You must be at least 18 years old to purchase a knife from Coyote Creek Co. By purchasing a knife, you represent that:

  • You are at least 18 years old.

  • You may legally purchase, receive, possess, carry, and use the knife in your jurisdiction.

  • The product may legally be shipped to the delivery address provided.

  • You will use the product responsibly and only for lawful purposes.

  • You will not provide the product to a person who is prohibited from possessing it.

Knife laws vary by state and locality. Coyote Creek Co. will not knowingly sell or ship a product where the sale or shipment is prohibited. We may restrict or cancel an order based on the product, destination, age-verification requirements, or applicable law. Customer representations do not eliminate our responsibility to comply with applicable law.

Certain products, including automatic-opening knives, may be unavailable for shipment to particular destinations or purchasers. We reserve the right to request proof of age or other eligibility information before accepting or fulfilling an order.

Knives are sharp tools capable of causing serious injury. Keep all knives away from children and use appropriate care. Coyote Creek Co. is not responsible for injury, loss, or damage caused by unlawful, reckless, improper, or unintended use after delivery.

  1. PRODUCT INFORMATION

We make reasonable efforts to display product descriptions, specifications, photographs, colors, dimensions, and prices accurately. However, screen settings, lighting, manufacturing tolerances, natural material variations, and engraving processes may cause minor differences in appearance.

Natural and manufactured materials may vary in color, grain, texture, finish, or pattern. These normal variations are not considered defects.

We reserve the right to correct errors, inaccuracies, or omissions and to update product information at any time.

  1. PRICES AND PAYMENT

All prices are displayed in U.S. dollars unless otherwise stated. Prices may change without notice.

Applicable taxes, shipping charges, and other fees will be calculated and displayed during checkout.

You agree to provide current, complete, and accurate billing, payment, shipping, and contact information. You authorize us and our payment processors to charge the payment method submitted for the total amount of the order.

  1. ORDERS

Submitting an order does not guarantee acceptance. We reserve the right to refuse, limit, or cancel an order for reasons that include:

  • Product unavailability

  • Pricing or listing errors

  • Suspected fraud or unauthorized payment activity

  • Incomplete or inaccurate customer information

  • Age or legal-compliance concerns

  • Shipping restrictions

  • Suspected resale or prohibited use

  • Conduct that violates these Terms of Service

If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method.

  1. CUSTOM ENGRAVING AND PERSONALIZATION

Customers are responsible for reviewing all names, initials, dates, messages, spelling, punctuation, artwork, placement selections, and other personalization details before submitting an order or approving a proof.

When a proof or mockup is provided, customer approval authorizes us to proceed. Coyote Creek Co. is not responsible for errors contained in information or artwork submitted or approved by the customer.

Minor differences in engraving color, depth, contrast, position, or appearance may occur because of variations in materials, coatings, finishes, blade shapes, and manufacturing tolerances. These normal production variations are not considered defects.

Personalized or made-to-order purchases cannot be canceled, changed, returned, or refunded after engraving or production has begun, except when the item is defective, damaged during shipment, or does not match the approved order because of an error by Coyote Creek Co.

  1. CUSTOMER-SUBMITTED ARTWORK

By submitting a logo, design, photograph, name, text, or other material, you represent that you own the material or have permission to use and reproduce it.

You grant Coyote Creek Co. a limited license to reproduce and modify submitted material only as reasonably necessary to prepare, engrave, manufacture, and fulfill your order.

You agree not to submit material that:

  • Infringes another party’s copyright, trademark, publicity, privacy, or other rights

  • Is unlawful, threatening, fraudulent, defamatory, or deceptive

  • Promotes unlawful violence or criminal activity

  • Contains malicious software or harmful code

We may refuse any design or personalization request at our discretion. The customer is responsible for claims resulting from material the customer submitted without proper authorization.

  1. COYOTE CREEK INTELLECTUAL PROPERTY

The Coyote Creek Co. name, logo, branding, original artwork, product photographs, mockups, graphics, written content, and website design are owned by or licensed to Coyote Creek Co. and may not be copied, reproduced, sold, distributed, or used commercially without written permission.

Purchasing an engraved product does not transfer ownership of Coyote Creek Co.’s underlying artwork, design files, templates, photographs, or intellectual property.

  1. SHIPPING AND DELIVERY

Processing and delivery dates are estimates unless expressly stated otherwise. Custom and personalized orders may require additional production time.

Customers are responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect or incomplete customer-provided address may be charged to the customer.

If we cannot ship an order within the timeframe promised, we will provide an updated timeframe and any cancellation or refund option required by applicable law.

Additional shipping terms are provided in our Shipping Policy and are incorporated into these Terms of Service.

  1. RETURNS, REFUNDS, AND CANCELLATIONS

Returns, refunds, exchanges, damaged-product claims, and cancellations are governed by our Return and Refund Policy, which is incorporated into these Terms of Service.

Personalized and made-to-order items are generally final sale after engraving or production has begun, except when the item is defective, damaged, or incorrect due to an error by Coyote Creek Co.

  1. MANUFACTURER WARRANTIES

Some products may include a warranty provided by the original manufacturer. Manufacturer warranties are governed by the manufacturer’s terms, exclusions, and claim procedures.

Coyote Creek Co. does not expand, replace, or modify a manufacturer’s warranty unless we expressly agree to do so in writing. We may assist customers with locating the appropriate manufacturer warranty information.

  1. THIRD-PARTY SERVICES AND LINKS

Our website may use or link to services provided by Shopify, payment processors, shipping carriers, manufacturers, social-media platforms, and other third parties.

We are not responsible for the content, availability, security, privacy practices, or actions of independent third-party services. Your use of those services may be subject to separate third-party terms and policies.

  1. PROHIBITED USES

You may not use the website or its content to:

  • Violate any law or regulation

  • Infringe intellectual-property rights

  • Submit false, misleading, or fraudulent information

  • Transmit malware or harmful code

  • Interfere with the website’s operation or security

  • Collect information about other users without authorization

  • Harass, threaten, abuse, or harm another person

  • Purchase or use a product for an unlawful purpose

  • Circumvent age, location, shipping, or purchasing restrictions

We may suspend or terminate access to the website or cancel an order when these terms are violated.

  1. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, the website and its content are provided on an “as available” basis without warranties that access will always be uninterrupted, timely, secure, or error-free.

Nothing in these terms excludes product warranties or consumer rights that cannot legally be excluded.

  1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Coyote Creek Co. LLC and its owner, agents, contractors, service providers, and suppliers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of the website or products.

Our total liability relating to a purchase will not exceed the amount paid for the product giving rise to the claim, except where applicable law does not permit such a limitation.

Nothing in these terms limits liability that cannot legally be limited or excluded.

  1. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold Coyote Creek Co. LLC harmless from third-party claims, damages, liabilities, and reasonable expenses resulting from:

  • Your unlawful or prohibited use of a product

  • Your violation of these Terms of Service

  • Your violation of another party’s rights

  • Artwork or other material you submitted without proper authorization

  1. SEVERABILITY

If any provision of these Terms of Service is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in effect.

  1. NO WAIVER

Our failure to enforce a provision of these Terms of Service does not waive our right to enforce that provision later.

  1. ENTIRE AGREEMENT

These Terms of Service, together with our Return and Refund Policy, Privacy Policy, Shipping Policy, and other posted store policies, constitute the agreement between you and Coyote Creek Co. concerning your use of the website and purchases from us.

  1. GOVERNING LAW

These Terms of Service are governed by the laws of the State of Colorado and applicable federal law, without limiting any consumer rights that cannot legally be waived.

  1. CHANGES TO THESE TERMS

We may update these Terms of Service by posting a revised version on the website. Changes apply from the posted effective date. Continued use of the website after an update constitutes acceptance of the revised terms.
